PFAS: EPA's PFAS Action Plan
The most recent federal and state developments relating to per - and polyfluoroalkyls Substances (PFAS) contamination.
In February 2019, the United States Environmental Protection Agency (EPA) released its first Comprehensive Nationwide PFAS Action Plan, which will likely impact the regulated community in Pennsylvania, including PMAA members. According to EPA, its Action Plan "outlines concrete steps the agency is taking to address PFAS and to protect public health".
The Action Plan addresses various areas of concern related to PFAS, including:
• Risk Communication
• Research
• Cleanup
• Enforcement
EPA also intends to propose nationwide drinking water monitoring for PFAS under the next Unregulated Contaminant Monitoring Rule (UCMR).
At the same time that EPA announced its Action Plan, the Pennsylvania Department of Environmental Protection (DEP) announced its intention to move forward with its own drinking water standards for PFOA and PFAS, two of the most prevalent PFAS chemicals.
Steven A. Hann, PMAA East Solicitor, will review EPA's Action Plan; explain the potential actions to be taken by both EPA and DEP and the timing of such actions.
He will also discuss how PFAS contamination has been addressed in Pennsylvania, review actions taken by other states regarding PFAS, whether actions taken elsewhere may be relied upon by Pennsylvania, litigation related to PFAS contamination and what the immediate future holds for this quickly evolving area of interest to PMAA members.
